Do we need an expert?
In bringing a prosecution, investigators are concerned with collecting sufficient evidence to prove the key elements of an offence and considering whether there are any viable defences which may be relied upon by potential defendants.
What happens when there are technical, scientific or specialised issues that need to be addressed or explained? How do you know whether you need an expert? When do you engage one? How do you prepare an expert witness for hearing?
Given the nature of compliance, monitoring and enforcement under the Resource Management Act, it is critical for investigators to have a general understanding of the life-cycle of expert witnesses. This presentation provides a high-level overview of the use of expert evidence and seeks to provide practical tips to enforcement officers operating on the frontline.
